Customer Must Read and Sign Below

ACCESS TO CUSTOMER’S PREMISES: Employees of MMU shall be granted access to the customer’s premises at all reasonable hours for the purpose of reading meters, inspecting utility services, making repairs and installing or removing any or all of MMU’s property. Customer acknowledges the right to repair and bill the Customer for damaged equipment.

CUSTOMER RESPONSIBILITIES: The Customer hereby states that all information provided as set forth in this application for services is true and complete. The Customer understands that one or more false statements on this application for services shall be considered sufficient cause to immediately terminate all utility services without any notice to the Customer whatsoever. MMU is hereby authorized to make any investigation of Customer’s financial and credit records through any investigative or credit agencies, bureaus, or other methods. The Customer understands that if any person with a past due utility account is residing at the premises herein described at any point-in-time, all utility services may, at the sole discretion of MMU, be immediately disconnected at any time without any notice to Customer whatsoever.

MMU reserves the right to charge the Customer a deposit based on ownership/rental status and credit history. Deposits are calculated using an average history of the premise herein described. Deposits will be refunded to the Customer account after 13 consecutive months of on-time payments or when the Customer ceases all utility services with MMU.

The Customer agrees to pay-in-full for services rendered by execution of this application for services and further agrees to be bound by all MMU’s rates, rules, regulations, and policies, governing the services. MMU reserves the exclusive right to revise its rates, rules, regulations, and policies from time to time, and in such cases the new rates, rules, regulations, and policies shall apply to this customer. A monthly late payment penalty of 10% shall be added to service bills not paid prior to the delinquent date of each month. Services will be disconnected if payment is not made in full or if arrangements are not made for a delayed payment within five business days of the penalty date. If required payment is not received by 9:00 am on the date of disconnection, a $45.00 fee is assessed prior to reconnection during normal business hours and $100.00 for after normal business hours. MMU reserves the right to charge an additional deposit at the premise herein described should the Customer be on the disconnect list more than 3 times in a 12 month time frame. In addition, Customer agrees to pay for repair of damaged equipment resulting from anything except natural causes.

DISCLAIMER: MMU shall not be responsible for the water service line from the property line (including service pipes, and the apparatus and plumbing used in connection therewith), the gas fuel line from the gas meter (including all inside structure piping and appliances used in connection therewith), the sewer service line from public sewer main, and the electric service line as provided within MMU’s rules, regulations, and policies.

Per City Code Chapter 28, Article 1, Section 28-7, any over-billings by the utility shall have a five-year limitation for the refund of overpayments. MMU reserves the right to bill an account for up to one year for undercharges.

If after any default in this agreement to provide utility services MMU places any matter arising out of or concerning this agreement with an attorney, either to collect damages or in response to a legal action by you arising out of this Contract, Customer shall pay all MMU legal fees, and costs of collection.
